IMPORTANT – PLEASE CAREFULLY READ AND UNDERSTAND THESE TERMS OF SERVICE AND CONDITIONS OF SALE (“TERMS” OR “AGREEMENT”) BEFORE ACCESSING, USING, OR PLACING AN ORDER THROUGH OUR WEBSITE. THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITY, AND INCLUDE A DISPUTE RESOLUTION PROVISION THAT, SUBJECT TO CERTAIN EXCEPTIONS, REQUIRES ARBITRATION ON AN INDIVIDUAL BASIS AND LIMITS CLASS ACTIONS (SEE SECTION 16). These Terms are a legal agreement between you and Fitiger Life LLC (“FITIGER,” “Company,” “we,” “our,” or “us”) and govern your access to and use of https://fitiger.net (including any subdomains, mobile versions, and any linked applications or services, collectively, the “Site”), and any purchase of products from the Site.

By accessing or using the Site, creating an account, subscribing to any marketing list, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Site or purchase products from us.

1. Eligibility; Website Use

By using the Site, you represent that you are at least the age of majority in your jurisdiction and that you have the legal capacity to enter into a binding contract. If you are using the Site on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

2. Privacy; Security; Electronic Communications

Our Privacy Policy describes how we collect, use, disclose, and protect personal information. The Privacy Policy is incorporated into these Terms by reference and forms part of this Agreement. Please review it carefully.

You agree that we may communicate with you electronically (including via email, SMS where applicable, and notices posted on the Site) and that such communications satisfy any legal requirement that communications be in writing.

3. General Conditions; Prohibited Conduct

All content and materials on the Site are protected by United States and international intellectual property laws. You may access and use the Site for your personal, non-commercial use only, subject to these Terms.

You agree not to, and not to attempt to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, servers, networks, or accounts.
• Transmit malware, spyware, or other harmful code; scrape, crawl, or use automated means to access the Site in a manner that burdens the Site.
• Submit false or misleading information, impersonate any person, or misrepresent your affiliation.
• Infringe or violate our intellectual property rights or the rights of others.
• Harass, abuse, threaten, defame, or discriminate against others.
• Collect or track personal information of others without authorization.

We may suspend or terminate your access to the Site, cancel orders, or take other appropriate action if we reasonably believe you have violated these Terms, engaged in fraud, or created risk or legal exposure for us or others.

4. Products for Personal Use Only; No Resale

The Site is intended for direct-to-consumer sales. Products purchased through the Site are for personal, non-commercial use only and may not be resold, redistributed, exported, or used for commercial resale channels without our prior written consent. We reserve the right to limit or refuse orders that appear to be placed by resellers, distributors, or for export.

5. Important Safety Notice; No Medical Advice

FITIGER products may be intended to support emergency response scenarios. The Site and any content provided through the Site (including guides, videos, FAQs, blog content, and customer communications) are for general information only and are not medical advice, diagnosis, or treatment, and are not a substitute for training or professional medical guidance.

Emergency guidance (non-exhaustive):

• If an emergency is occurring, call 911 (or your local emergency number) immediately.
• Follow established choking rescue protocols and training from recognized organizations (for example, American Red Cross and American Heart Association) and your local authorities.
• Use products only as described in the applicable user manual and packaging. Improper use may cause injury or delay other interventions.
• If you have questions about whether a product is appropriate for your situation, consult a qualified healthcare professional.

YOU ASSUME FULL RESPONSIBILITY FOR THE SAFE AND PROPER USE OF ANY PRODUCT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT RESPONSIBLE FOR INJURY OR LOSS CAUSED BY MISUSE, FAILURE TO FOLLOW INSTRUCTIONS, OR DELAY IN SEEKING EMERGENCY ASSISTANCE.

6. Accuracy of Information; Product Imagery

We attempt to provide accurate information about products, pricing, and availability; however, the Site may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and to change or update information at any time without prior notice, including after you submit an order.

Product images are for illustrative purposes only. Actual product appearance and packaging may vary slightly, including due to manufacturing updates and compliance labeling requirements.

7. Pricing; Taxes; Promotions; Discount Codes

Prices are displayed in U.S. Dollars unless otherwise stated. Prices may change at any time. Prices generally do not include shipping, handling, taxes, duties, or other charges unless explicitly stated at checkout.

Promotions and discount codes are subject to additional terms and may be modified or discontinued at any time. Unless otherwise stated, discount codes are limited to one use per order and may not be combined.

8. Payment; Authorization; Fraud Prevention

By submitting payment information, you represent and warrant that you are authorized to use the payment method and that the payment information is accurate. We (and our third-party payment processors) may request additional verification to prevent fraud. We are not responsible for bank or card issuer fees.

We may use third-party payment processors to process transactions. Your use of those services may be governed by their terms and privacy policies. We do not store full payment card information on our servers except as permitted and necessary to facilitate transactions (for example, tokenized payment information handled by processors).

9. Order Placement and Acceptance; Order Changes; Cancellation

When you place an order, you will typically receive an order acknowledgement. This acknowledgement does not mean we have accepted your order. Acceptance occurs when we ship the product(s) and send a shipment confirmation.

We may refuse or cancel any order at any time in our reasonable discretion, including due to suspected fraud, inventory limitations, pricing errors, regulatory or shipping restrictions, or violation of these Terms. If we cancel an order after payment is authorized, we will issue a refund to the original payment method.

Order changes: Once an order is submitted, we may not be able to modify it. Please contact customer support as soon as possible if you need help; we cannot guarantee changes once processing begins.

10. Shipping; Delivery; Risk of Loss; Title

Shipping options, costs, and estimated delivery times are displayed at checkout and/or in our Shipping Policy. Delivery dates are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control.

You are responsible for providing accurate shipping information. If a shipment is returned due to an incorrect address or refusal of delivery, additional shipping charges may apply.

Unless otherwise required by law, risk of loss passes to you when the product is delivered to the carrier. Title passes at shipment (or as otherwise required by applicable law).

Delivery confirmation: Carrier delivery confirmation may be treated as sufficient proof of delivery, even without a signature, unless otherwise required by applicable law.

11. Returns, Refunds, and Exchanges

We want you to be satisfied with your purchase. Our return and refund terms may be described in a separate Return & Refund Policy posted on the Site (the “Return Policy”), which is incorporated into these Terms by reference. If there is any conflict, the Return Policy will control for returns/refunds.

Default consumer return framework (unless a posted Return Policy states otherwise):

• Return window: You may request a return within thirty (30) days of delivery.
• Condition: Unopened and unused products in original packaging are eligible for return. For hygiene and safety reasons, opened products are generally not returnable unless defective.
• Defects/damage: If a product arrives damaged or has a verified manufacturer defect, contact us promptly for replacement or refund options.
• Return authorization: Returns require prior authorization. Unauthorized returns may be refused.
• Refunds: Approved refunds are issued to the original payment method after receipt and inspection. Shipping fees may be non-refundable except where required by law or where the return is due to our error or a verified defect.

We do not accept returns of products that have been altered, misused, or damaged due to improper storage or handling. Additional restrictions may apply to promotional items, bundles, or limited-edition products.

12. Limited Warranty; Manufacturer Defects

To the extent required by applicable law, certain products may come with a limited warranty. Any written warranty terms provided with a product (including in the user manual or packaging) are incorporated by reference. If you believe a product has a manufacturer defect, contact us with your order details and a description of the issue.

EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN WARRANTY, ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Intellectual Property; DMCA Notice

The Site and its content—including text, graphics, images, videos, product designs, trademarks, service marks, logos, and software—are owned by or licensed to FITIGER and are protected by intellectual property laws. You may not use, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written permission, except as expressly permitted by these Terms.

DMCA / Copyright Complaints

If you believe material on the Site infringes a copyright you own or control, you may submit a notice consistent with the Digital Millennium Copyright Act (“DMCA”) to our designated agent:

Your notice should include: (i) identification of the copyrighted work; (ii) identification of the allegedly infringing material and its location; (iii) your contact information; (iv) a statement of good-faith belief; (v) a statement under penalty of perjury that the notice is accurate; and (vi) your physical or electronic signature.

14. Reviews, Testimonials, and User Submissions

You may have the opportunity to submit reviews, comments, images, videos, testimonials, or other materials (“Submissions”). By providing a Submission, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, distribute, display, publish, perform, and create derivative works from your Submission in connection with operating, marketing, and improving our business and products.

You represent that your Submissions are accurate and do not violate any law or third-party rights. We may remove Submissions at our discretion.

15. Disclaimers of Warranties; Limitation of Liability

DISCLAIMER OF WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, CONTENT, AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FITIGER OR ITS MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS.

IN ALL CASES, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS BEFORE THE EVENT, OR USD $500, WHICHEVER IS LESS, UNLESS A GREATER AMOUNT IS REQUIRED BY LAW.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits any non-waivable consumer rights.

16. Dispute Resolution; Mandatory Arbitration; Class Action Waiver; Opt-Out

PLEASE READ THIS SECTION CAREFULLY. It affects your rights, including your right to file a lawsuit in court. Except where prohibited by law, you and FITIGER agree that disputes will be resolved through binding arbitration on an individual basis.

16.1 Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, our marketing practices, or any product or service (each a “Dispute”) shall be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, and governed by the Federal Arbitration Act (“FAA”). The arbitrator shall have exclusive authority to determine the arbitrability of any Dispute.

16.2 Class Action Waiver

YOU AND FITIGER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any class, collective, or representative proceeding.

16.3 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent unauthorized use of the Site, and either party may bring qualifying claims in small claims court if the claim is within that court’s jurisdiction and proceeds on an individual basis.

16.4 Opt-Out Right

You may opt out of arbitration by sending written notice within thirty (30) days of the first date you access the Site or purchase a product (whichever is earlier). Your notice must include your name, address, email, order number (if any), and a clear statement that you wish to opt out of arbitration. 16.5 Location; Fees; Rules

Arbitration will take place remotely or in San Mateo County, California, unless the parties agree otherwise. Payment of filing, administration, and arbitrator fees will be governed by AAA rules, subject to any fee-shifting provisions required by law.

17. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless FITIGER and its affiliates and their respective officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of products; (c) your violation of any law; or (d) your infringement of any third-party rights.

18. Third-Party Links; Social Media

The Site may contain links to third-party websites, services, or social media platforms. We do not control and are not responsible for third-party content, practices, or policies. Your interactions with third parties are governed by their terms.

19. Force Majeure

We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, pandemics, supplier failures, carrier delays, or governmental actions.

20. Governing Law; Venue (Where Permitted)

Except to the extent preempted by the FAA in Section 16, these Terms and any Dispute shall be governed by the laws of the State of California, without regard to conflict-of-laws principles. Where litigation is permitted under these Terms, the parties consent to jurisdiction and venue in the state or federal courts located in California, unless otherwise required by law.

21. Notices

We may provide notices to you by email, through your account (if applicable), or by posting on the Site. Notices are effective when sent or posted. You are responsible for keeping your contact information current.

To provide notice to us (other than routine customer support requests), send notice by certified mail, recognized courier, or email to the Contact Information in Section 23.

22. Assignment; No Waiver; Severability; Termination; Entire Agreement

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.

Severability: If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Termination: We may suspend or terminate your access to the Site at any time. Sections intended to survive termination, including Sections 4–5 and 13–22, will survive.

Entire Agreement: These Terms, together with the Privacy Policy and any policies referenced herein (including Shipping and Return policies posted on the Site), constitute the entire agreement between you and FITIGER regarding the Site and purchases.
